This release is entered into between The 5-Day Shape Up Your Plate Challenge member or FREE participant and Karen Hartnett or DBA Divine Strength Fitness, its officers, directors, employees and agents upon the understanding and condition for the purpose of both nutrition and physical fitness services. It provides nutritional information in the form of shopping lists, recipes and menus, along with strength and flexibility, alignment exercises or postures. It provides both instruction, coaching, motivation, and educational opportunities for both dietary and physical fitness improvement and goal attainment, in conjunction with care overseen by either participants who have paid for a membership or accepted a FREE posture exercise in the form of an opt-in. The participants, either free or paid, should consult the necessary physician and necessary health care providers before participating in the FREE opt in exercise, The Divine Strength 5-Day Shape Up Your Plate and Posture Challenge, Divine Strength 40-Day Whole body Transformation and or purchase the book The Divine Strength Diet Plan.
THE PARTICIPANT acknowledges that The 5-Day Shape Up Your Plate and Posture Challenge along with information provided in The Divine Strength Diet Plan does not guarantee that or instruction provided will produce good nor bad results. The program participant acknowledges that both the nutritional and physical fitness advice provided during these paid and any FREE services is based on best practices and nutritional guidelines for health and that, should chronic health conditions be present, the participant must be responsible for consulting with a primary care physician for thorough evaluations and healthcare.
By clicking the checked box named (Medical Disclaimer) on the Challenge Opt-in form, the program participant acknowledges that they have read and accepted ALL the medical risks that may result from such participation in an exercise and nutrition program, whether it be FREE or PAID.
By agreeing to participate in this programming, I have consulted my personal physician or other health authority and I am physically capable of such participation without injury. I recognize the risks of both nutritional and physical changes by participating in The Divine Strength 5-Day Shape Up Your Plate and Posture Challenge upon the express agreement and understanding that as a participant in the online programming stated I do hereby for myself and my heirs, executors, and administrators waive and release Karen Hartnett/DBA Divine Strength Personal Training and Diet Center from any and all claims, costs, liability, expenses or judgments including attorney’s fees and court cost (herein, collectively “Claims”) arising out of my participation in any FREE posture or alignment exercise or in The Divine Strength 5-Day Shape Up Your Plate and Posture Challenge or any illness or injury resulting there from, and hereby agree to indemnify and hold harmless Karen Hartnett and any of its employees from and against any and all such claims.
In consideration of my entry and of my own free will, I waive, release, and give up any and all claims, demands, liability.
